Terms and Conditions

1. Booking and Payment:

a. A non-refundable booking fee of [insert percentage or amount] is required to secure the date for the shoot with Everything Deena. The remaining balance is due on the day of the shoot.

b. Payments can be made via cash or bank transfer and will be discussed prior to the shoot.

c. In the event of late payment

d. In the event of cancellation by the client, the booking fee is forfeited unless otherwise agreed upon.

2. Payment Terms and Late Fees:

a. The client agrees to submit the full payment as outlined in the agreed-upon terms. Any payment not received by the due date will be considered late. Everything Deena reserves the right to charge a late fee of [insert amount or percentage] for payments received aIer the due date. Additionally, late payments may result in the rescheduling or cancellayion of the shoot at Everything Deena's discretion. The client will be notified of any late fees and/or changes to the shooting schedule in writing.

3. Shoot Details:

a. The client agrees to provide accurate details regarding the shoot location, date, and time to Everything Deena.

b. Any changes to the shoot details must be communicated and agreed upon in writing at least [insert timeframe] days before the scheduled shoot.

c. Any changes requested by the client to the shoot details after the initial agreement may result in additional costs. Everything Deena will make reasonable efforts to accommodate such changes, but the client will be responsible for any associated expenses, including but not limited to additional shoot time, location fees, or equipment rentals. Everything Deena will provide an estimate of the additional costs incurred due to client-requested changes, and the client must approve these costs in writing before the changes are implemented. Failure to approve additional costs may result in the shoot proceeding as originally agreed upon, and the client will still be responsible for any previously agreed- upon fees.

4. Shoot Time and Locations

a. The shoot time and locations specified in the chosen package with Everything Deena are final unless otherwise agreed upon.

b. Additional fees may apply for extra shoot time or locations beyond the agreed package.

5. Deliverables:

a. Everything Deena will deliver the agreed-upon number of edited photos/videos within [insert timeframe] days aIer the shoot.

b. The client will receive the edited photos/videos via [insert delivery method]..

c. Everything Deena will deliver the final edited photos/videos to the client in [insert format], with a resolution suitable for [insert purpose, e.g., printing, online use]. Everything Deena will make reasonable efforts to ensure that the deliverables meet the client's needs and expectations; however, the client acknowledges that variations in display seings and printing processes may affect the appearance of the photos/videos. Any specific requirements regarding file format or resolution must be communicated to Everything Deena in writing prior to the shoot. Client agrees to review the delivered photos/videos promptly upon receipt and notify Everything Deena of any concerns or discrepancies within [insert timeframe] days.

6. Usage Rights:

a. The client is granted non-exclusive usage rights to the edited photos/videos provided by Everything Deena for personal or promotional use.

b. Everything Deena retains copyright ownership of all photos/videos and reserves the right to use them for promotional purposes, unless otherwise agreed upon.

7. Client Cooperation:

a. The client agrees to cooperate with Everything Deena to ensure the success of the shoot.

b. Any delays caused by the client may result in reduced shoot time and/or additional fees.

8. Equipment and Substitution:

a. Everything Deena will provide their own equipment necessary for the shoot.

b. In the event of equipment failure or unforeseen circumstances, Everything Deena will make reasonable efforts to substitute equipment and/or reschedule the shoot at no additional cost to the client.

9. Liability:

a. Everything Deena is not liable for any damages or injuries incurred during the shoot.

b. The client is responsible for obtaining any necessary permits or permissions for the shoot locations.

10. Image/Video Retention:

a. Everything Deena will retain the original, unedited photos/videos for a period of [insert timeframe] days aIer delivery of the final edited photos/videos.

b. The client may request additional edits within this timeframe, subject to additional fees.

11. Travel and Expenses:

a. Travel outside of a [insert radius] mile radius from [insert base location] may incur additional travel expenses, including but not limited to accommodation, transportation, and meals.

b. Any such expenses will be communicated to the client and agreed upon in writing prior to the shoot. These expenses will either be included in the package price or billed separately.

c. In the event that the shoot requires travel outside of a [insert radius] mile radius from [insert base location], additional travel expenses may apply. Everything Deena will provide an estimate of these expenses to the client, including but not limited to accommodation, transportation, and meals, prior to the shoot. Client agrees to review and approve these expenses in writing before the shoot commences. Any approved travel expenses will be documented and invoiced separately from the shoot fee. Client agrees to reimburse Everything Deena for approved travel expenses within [insert timeframe] days of receiving the invoice.

12. Additional Services and Fees:

a. Any additional services requested by the client beyond the scope of the chosen package will be subject to additional fees.

b. Additonal services may include but are not limited to drone footage, extra editing, or specialized equipment rental..

c. The pricing for additonal services will be provided to the client upon request and agreed upon in writng before implementation.

d. The client may request additional services beyond the scope of the agreed-upon package. To request additional services, the client must submit a wri1en request to Everything Deena detailing the specific services requested. Everything Deena will provide a quote for the additional services requested, including any associated costs and timelines for implementation. The client must review and approve the quote in writing before additional services will be provided. Implementation of additional services will be scheduled based on availability and agreed-upon timelines. Any changes to the scope or timeline of additional services must be communicated and agreed upon in writing by both parties.

13. Client Responsibilities:

a. The client is responsible for providing any necessary props, wardrobe, or accessories required for the shoot unless otherwise arranged with Everything Deena.

b. The client must obtain any required permits, permissions, or clearances for access to shoot locations, including but not limited to private properties, parks, or event venues.

c. The client agrees to ensure the availability of key subjects or locations at the designated shoot time and location.

d. The client acknowledges that the success of the shoot depends on the accurate and timely provision of information and cooperation from both parties. Client agrees to promptly provide all necessary information requested by Everything Deena, including but not limited to shoot details, location access, and any specific preferences or requirements. The client understands that failure to provide accurate or timely information may impact the quality or success of the shoot and agrees to take responsibility for any such impact. Client further agrees to cooperate with Everything Deena during the shoot to facilitate a smooth and productive process.

14. Delivery Format:

a. The final edited photos/videos will be delivered to the client in [insert format], either electronically or via physical media, as agreed upon between the client and Everything Deena.

b. The client will receive the photos/videos within [insert timeframe] days aIer the shoot unless otherwise specified.

c. n the event of late payment

d. In the event of cancellation by the client, the booking fee is forfeited unless otherwise agreed upon.

15. Rescheduling and Cancella8on Policy:

a. Requests for rescheduling or cancellation of the shoot must be communicated to Everything Deena as soon as possible.

b. In the event of cancellation by the client, the booking fee is non-refundable unless otherwise agreed upon.

c. Everything Deena reserves the right to retain the booking fee and/or charge additional fees for rescheduling or cancellation within [insert timeframe] days of the scheduled shoot date.

d. Everything Deena reserves the right to cancel or reschedule a shoot due to unforeseen circumstances, including but not limited to inclement weather, equipment failure, or illness. In such cases, Everything Deena will make reasonable efforts to notify the client as soon as possible via [insert preferred communication method]. If a shoot must be canceled or rescheduled by Everything Deena, the client will have the option to reschedule the shoot at no additional cost or receive a full refund of any payments made. Client agrees to provide Everything Deena with at least [insert timeframe] days notice if they need to cancel or reschedule the shoot. Failure to provide sufficient notice may result in forfeiture of the booking fee or additional fees for rescheduling.

16. Insurance:

a. Everything Deena carries liability insurance covering damages or injuries incurred during the shoot, within the limits of the policy.

b. Clients are encouraged to obtain their own insurance coverage for any additional protection or indemnification.

c. Everything Deena maintains liability insurance to cover damages or injuries that may occur during the shoot, within the limits of the policy. However, clients are advised to review their own insurance coverage to ensure they are adequately protected in the event of unforeseen circumstances during the shoot. Everything Deena cannot be held liable for any damages or losses not covered by the client's insurance policy. By booking our services, the client acknowledges and accepts this recommendation to review their insurance coverage.

17. Dispute Resolution:

a. Any disputes arising from or relating to these terms and conditions or the services provided by Everything Deena shall be resolved through mediation or arbitration, as mutually agreed upon by both parties.

b. In the event that mediation or arbitration is unsuccessful, legal action may be pursued in accordance with applicable laws and regulations.

c. In the event that mediation or arbitration is unsuccessful in resolving any disputes arising from or relating to these terms and conditions or the services provided by Everything Deena, both parties agree that any legal proceedings shall be brought exclusively in the courts of [insert jurisdiction], and both parties hereby consent to the exclusive jurisdiction and venue of those courts for any such purposes.

18. Agreement:

a. Client acknowledges that they have read, understand, and agree to abide by the terms and conditions outlined herein. Client agrees to sign and return a copy of these terms and conditions to Everything Deena as confirmation of their acceptance and agreement, prior to the scheduled shoot date. Failure to return a signed copy of the terms and conditions may result in the postponement or cancellation of the shoot.

b. Client further acknowledges that their continued use of Everything Deena's services constitutes acceptance of these terms and conditions.
